Basic rights during a police investigation

Criminal Law · · 4 min read · By Prastitis Law

Being called to a police station, or becoming involved in a police investigation, is understandably stressful. Knowing your basic rights at this stage is the first and most important step in protecting yourself.

The right to a lawyer

Anyone arrested or held in custody has the right of immediate access to a lawyer of their choice. Exercising that right before giving any statement is essential — what is said in the early stages of an investigation can decisively affect how a case develops.

The right to silence

No one is obliged to incriminate themselves. The right to silence is fundamental, and relying on it may not be interpreted against you.

Being informed of the reasons for arrest

If you are arrested, you are entitled to be informed promptly, in a language you understand, of the reasons for your arrest.

Every case has its own particular circumstances. If you or someone close to you becomes involved in a police investigation, we recommend seeking legal advice as early as possible.
